Terms and conditions

These terms govern access to and use of the Smart Digital Menu app and menus published through the service.

Read these Terms carefully before creating an account or publishing a menu. By using the Service, you confirm that you understand and accept them.

1. Provider, acceptance and eligibility

Smart Digital Menu (the “Service”) is provided by Smart Digital Menu / smartdigital.menu. For questions, email info@smartdigital.menu.

By creating an account or using the Service, you accept these Terms and the Privacy Notice. If you do not accept them, do not use the app. You must be at least 18 and able to enter into a contract, or act for a business that has authorized you.

The current version is offered without a direct charge. Any future paid features, subscriptions or purchases will show their price and conditions before you assume a payment obligation.

2. Service features

The Service lets you create and update venue details, opening hours, digital menus, categories, dishes, drinks, prices, descriptions, images, ingredients, allergens, tags, translations and themes, and publish content through a link or QR code.

Smart Digital Menu is a technical tool. It does not sell food, process payments, manage reservations or form contracts between venues and menu visitors.

Some features depend on an internet connection, operating system, third-party services or device compatibility. Offline features allow local work within the limits described in the app; a change becomes public only after successful synchronization.

3. Account and security

Access is managed through Firebase Authentication using methods available in the app, such as email and password, phone, Google or Apple. You must provide accurate information and keep account contact details current.

You are responsible for credential confidentiality, device security and activity through your account. Do not share access with unauthorized people. Promptly report suspicious access, device loss or compromised credentials to info@smartdigital.menu.

We may require re-authentication for sensitive actions such as changing sign-in providers or permanently deleting the account.

4. User content and venue responsibility

You retain ownership of content you enter. You grant us a non-exclusive, worldwide, royalty-free licence limited to the relationship term to store, reproduce, technically adapt, publish and translate it only as necessary to provide, protect and improve the Service.

You confirm that you hold all necessary rights and permissions for text, images, trademarks and other content. Do not upload unlawful, misleading, defamatory, discriminatory or dangerous material, or content that infringes privacy or intellectual-property rights.

The venue is solely responsible for the accuracy and currency of prices, availability, ingredients, allergens, dietary characteristics and consumer information. Before publication, you must review content and comply with law applying to your business.

Do not enter unnecessary personal or sensitive data. If you publish third-party data or images, you are responsible for the relevant legal basis, notice and authorization.

5. Automatic translations

Automatic translations are generated only at your request through an AI provider described in the Privacy Notice. Selected text is transmitted to the provider to produce the translation.

An automatic translation may be incomplete, ambiguous or wrong. Review it before publishing, particularly ingredients, allergens, warnings, quantities, prices and consumer information. Do not rely on a translation as medical, legal or professional advice.

6. Acceptable use and illegal content

You may not use the Service for unlawful, fraudulent or harmful activity; access or try to access another person’s data; bypass limits or security measures; introduce malware; scrape or send automated requests that overload infrastructure; resell the Service without permission; or interfere with its operation.

We may limit, remove or disable content and suspend an account for Terms violations, security risks, authority requests, legal duties or concrete danger to users or third parties. Where appropriate, we will communicate reasons and appeal options.

To report potentially illegal public content, email info@smartdigital.menu with the relevant URL or menu, reason, reporter name and contact details, and a good-faith statement that the information is accurate. We will process the report without undue delay.

7. Service intellectual property

Smart Digital Menu software, interface, graphics, trademarks, documentation and components belong to the provider or relevant licensors. We grant you a personal, limited, revocable, non-exclusive and non-transferable right to use the Service under these Terms.

You may not copy, modify, sell, sublicense, distribute, decompile, reverse engineer or create derivative services except where mandatory law or an applicable open-source licence expressly permits it.

We may use feedback and suggestions to improve the Service without compensation, while you retain ownership of your content.

8. Availability, changes and third-party services

We take reasonable measures to keep the Service available and secure but do not guarantee uninterrupted or error-free operation. Maintenance, updates, networks, hosting, Firebase, identity providers, AI services and mobile platforms may cause delay or interruption.

We may fix, update, add, limit or discontinue features for technical, operational, security or regulatory reasons. If a change materially affects use, we will provide reasonable notice where possible.

Third-party services are also governed by their own terms and privacy notices. We do not control their availability, changes or independent decisions.

9. Term, suspension and deletion

You may stop using the Service at any time. You can delete the account in the app after a recent identity check or, if a verified email is linked, through a single-use link sent to that address from the website.

Deletion removes the account, menus and linked data from active systems, except information retained for law, security or dispute handling. Residual technical copies disappear through the normal backup cycle as explained in the Privacy Notice.

We may suspend or close an account for serious or repeated breach, security risk, authority order or service discontinuation. Where law and security permit, we will communicate the action and available appeal process.

10. Warranties and liability

The Service is provided as currently available. To the extent permitted by law, we do not promise that it meets every specific requirement and are not responsible for user content, unreviewed translations, inaccurate food information, venue business decisions or problems caused by devices, networks and external services.

To the extent permitted by law, we are not liable for indirect loss, lost profits, opportunity, reputation or data caused by misuse, failed publishing, temporary unavailability or user content. Users should keep reasonable copies of important content and verify publication results.

Nothing in these Terms limits mandatory rights or warranties or liability that cannot be excluded by law, including liability for wilful misconduct, gross negligence or personal injury where applicable. Consumers keep all mandatory protections.

11. Changes, governing law and contact

We may update these Terms when the Service, providers or law changes. A new version will show its date and version number; material changes will be communicated appropriately. Continued use after the effective date constitutes acceptance unless law requires a different form of consent.

Italian law applies. Consumers retain mandatory protections of their country of residence and may use the court competent under applicable law. Before a dispute, we invite you to contact us to seek a solution.

If a provision is invalid or unenforceable, the others remain in effect. Failure to exercise a right is not a waiver. You may not transfer the account or contract without permission; the provider may transfer the relationship as part of a reorganization or sale while respecting your rights.
